Terms of Service

1. Acceptance of Terms

By accessing or using STRProof ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including hosts, co-hosts, cleaners, and guests who interact with STRProof through shared links.

1.1 Modifications

We may update these Terms from time to time. We will notify you by email and through the Service at least 30 days before material changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

1.2 Additional Terms

These Terms incorporate our Privacy Policy and Cookie Policy by reference.

3. Subscription and Payment

3.1 Plans

STRProof offers the following plans:

Plan features and pricing may change with 30 days' notice.

3.2 Billing

• Paid plans are billed monthly in advance through our payment processor (Stripe).
• You authorize us to charge the applicable fees to your payment method.
• Prices are listed in USD. Applicable taxes, VAT, GST, or other local taxes may be added based on your billing address or jurisdiction. We will display the total price including taxes before you confirm payment.
• Prices may vary by region to account for local market conditions, taxes, and currency conversion. The price displayed at checkout is the price you pay.

3.3 Plan Enforcement

If your usage exceeds your plan limits (for example, by having more properties than your plan allows), you must upgrade to an appropriate plan or reduce your usage. We reserve the right to restrict functionality that exceeds your plan limits.

3.4 Cancellation

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of your current billing period. Upon cancellation:

• Your account reverts to the Free plan
• Your data remains accessible
• No partial-month refunds are provided

3.5 Refund Policy

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 60 days of the charge at support@strproof.com.

5. Guest Rights

5.1 No Account Required

Guests interact with the Service through time-limited, cryptographically signed links. Guests are not required to create accounts, provide payment information, or install any application.

5.2 Guest Data

When a guest uses an approval or checkout link, we collect only the data necessary to document the property condition:

• Photos the guest uploads
• Notes the guest provides
• Timestamp of the guest's interaction
• IP address (for security purposes)

Guests retain the right to:

• Decline to provide photos or notes
• Not use the link (no penalty or obligation)
• Request deletion of their data (see Privacy Policy)

5.3 Link Expiry

Guest links expire after 48 hours (approval) or 24 hours (checkout). Expired links cannot be used and guest data from expired interactions is retained only as documentation for the host.

7. Acceptable Use

7.1 Permitted Use

You may use the Service to:

• Document short-term rental property condition
• Share property condition documentation with guests
• Generate evidence reports for legitimate disputes
• Manage cleaning and turnover workflows

7.2 Prohibited Use

You may not use the Service to:

• Violate any applicable law or regulation
• Infringe on any person's privacy rights
• Harass, threaten, or intimidate guests or other users
• Upload content depicting illegal activity
• Use the Service for properties you do not own or manage without authorization
• Attempt to reverse engineer, decompile, or access the Service's source code
• Use automated tools to access the Service beyond documented APIs
• Share guest personal information with third parties without consent
• Use the Service to create fraudulent or misleading documentation

7.3 Enforcement

We reserve the right to suspend or terminate accounts that violate these Terms. We will provide notice and an opportunity to cure when possible.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Legal Advice

STRProof is a documentation tool. It does not provide legal advice, legal opinions, or legal representation. Reports generated by the Service are factual documentation, not certified legal evidence. Consult an attorney for legal matters.

9.3 No Guarantee of Outcomes

We do not guarantee that using STRProof will result in winning any dispute, recovering any deposit, or prevailing in any insurance claim. The Service documents property condition — how that documentation is used is your responsibility.

9.4 Service Availability

We strive for high availability but do not guarantee uninterrupted access. We are not liable for temporary outages, maintenance windows, or force majeure events.

11. Indemnification

You agree to indemnify and hold harmless STRProof, its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any applicable law or third-party right

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

For users outside the United States: Nothing in these Terms reduces your rights under the mandatory laws of your country of residence. If local law prohibits any provision of these Terms, that provision does not apply to you to the extent prohibited, but the rest of these Terms remain in effect.

13.2 Dispute Resolution

United States users: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in Austin, Texas, or remotely at your election.

International users: We encourage you to contact us first at support@strproof.com to resolve any dispute informally. If we cannot resolve the dispute within 60 days, you may pursue claims in the courts of your country of residence or through arbitration as described above, at your election. If your local law provides greater consumer protection rights than these Terms, those local rights are preserved.

13.3 Class Action Waiver

You agree to resolve disputes with us individually. You waive any right to participate in a class action, collective action, or representative proceeding, except where this waiver is prohibited by the laws of your jurisdiction (for example, under EU consumer protection law).

13.4 Exceptions

You may bring claims in small claims court or equivalent local proceedings if they qualify. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized access.
